In the United States, all workers have a right to:

  • Join a union

  • Attend union meetings

  • Speak to union organizers

  • Declare oneself a union supporter

  • Assist in forming a union

Under federal law, employers may not:

  • Threaten workers with punishment if workers engage in union activity

  • Threaten to shut down the business if workers form a union

  • Prevent unions from soliciting members outside of working hours

  • Question workers about union matters or union meetings

  • Ask whether workers belong to or plan to join a union

  • Transfer workers to less desirable working conditions as retaliation for joining a union

  • Threaten to terminate benefits or lower wages to prevent unionization

  • Threaten a layoff or a loss of jobs because of a union
